These Schedules form part of the Terms of Use and apply in addition to them. Each Schedule states the subscriptions it applies to.

More than one Schedule is published on this page. Only the Schedule that matches a subscription applies to that subscription:

  1. Schedule 1 - Standards Australia curated set subscription terms. Applies to a Subscription that provides access to a Curated Set other than under a Named User Subscription. Schedule 1 prevails for those subscriptions.
  2. Schedule 2 - Standards Australia Named User Subscription terms. Applies to a Subscription that provides access to Standards Australia Licensed Material under a Named User Subscription. Schedule 2 prevails for those subscriptions.

Where a Subscription is a Named User Subscription, Schedule 2 applies to that Subscription and Schedule 1 does not.


Schedule 1 - Standards Australia curated set subscription terms

1. Application

1.1 This Schedule applies if the User is provided with access to any Curated Set as part of their access to the Platform, other than under a Named User Subscription. If the User is provided with access under a Named User Subscription, Schedule 2 applies instead of this Schedule.

2. Definitions

2.1 In this Schedule, the following terms have the following meanings:

Authorised UserAn end user who is authorised by a Customer to access (including to view) or use Licensed Material.
Curated SetA set of Licensed Materials selected by Standards Australia, and includes: (a) NCC Primary References Set; and (b) NCC Primary References Historical Editions, Supplements and Amendments Set.
CustomerThe User (as defined in the Terms of Use).
DistributorClearCalcs Pty Ltd trading as Calcs.com (ABN 42 614 037 400).
Eligibility RequirementOrdinarily, none.

In respect of a Subscription only available to a Small Business, the business must be a Small Business at the time of subscription or renewed subscription to that Subscription.
Intellectual Property RightsAll present and future rights conferred by statute, at common law or in equity and wherever existing, including: (a) patents, designs, copyright, rights in circuit layouts, trademarks, know how, brand names, domain names, inventions, product names, trade secrets and any other rights subsisting in the results of intellectual effort in any field, whether or not registered or capable of registration; (b) any application or right to apply for registration of any of these rights; (c) any registration of any of these rights or any registration of any application referred to in paragraph (b); and (d) all renewals and extensions of these rights.
Licensed MaterialAny material, document or publication (in whole or in part) which Standards Australia has licensed the Distributor to distribute.
Permitted Number of Authorised UsersOrdinarily, as advised by the Distributor from time to time.

In respect of a Subscription only available to a Small Business, as advised by the Distributor from time to time, but in no case exceeding 4 single/named users (or lesser number specified by the Company).
Permitted Subscription TermOrdinarily, 12 months.

In respect of a Subscription only available to a Small Business, any of: (a) 12 months; (b) 24 months; or (c) 36 months (as determined and specified by the Company at the time of subscription).
Small BusinessA business that has between 1-19 employees.
Standards AustraliaStandards Australia Limited ABN 85 087 326 690.
SubscriptionAgreement, arrangement or understanding between the Distributor and a Customer which entitles one or more Authorised Users to access (including to view) or use the Licensed Material during a specified term.

3. Additional Terms

3.1 The Customer acknowledges that it meets the Eligibility Requirement (if any).

3.2 The Customer is granted a non-exclusive, non-transferrable, non-sublicensable, limited licence, for the relevant Permitted Subscription Term, to permit the relevant permitted number of Authorised Users specified in the subscription agreement, to access the item, with the right to add notes to the item but without the right to print, save or copy the whole or any part of the item.

3.3 The Customer may not sell, share, rent, lease or otherwise provide access to the Subscription and the Licensed Material or the Customer's (or its Authorised Users') login credentials to any individual or organisation other than the Customer's Authorised Users.

3.4 The Customer must ensure that the number of Customer's Authorised Users accessing the Subscription does not exceed the relevant permitted number of Authorised Users.

3.5 The Customer must take steps to ensure that its Authorised Users keep their relevant login credentials confidential and safe from access by unauthorised users.

3.6 The Customer agrees that:

  1. Standards Australia and its licensors are, and will remain, the owners of all Intellectual Property Rights in the Licensed Material;
  2. the Customer must not remove, alter or obscure any ownership, copyright, trade mark, confidentiality or other marks or legends (including any digital watermark or other digital rights management tool) on or in the Licensed Material;
  3. the Customer will protect the security of the Licensed Material in its possession and preserve the Licensed Material and Standards Australia's Intellectual Property Rights; and
  4. the Customer must ensure that its Authorised Users complies with these terms.

3.7 The Customer shall not loan, sell, rent, lease, reproduce, or otherwise distribute any of the Licensed Material obtained through the Subscription, in any format, by electronic mail or other means, to any individual or organisation other than an Authorised User at an authorised site, without the prior written permission of Standards Australia.

3.8 Each Authorised User must be a natural person and an internal staff of the Customer. If the Authorised User's employment relationship with the Customer terminates, the Customer must discontinue that Authorised User's access to the Licensed Materials.

3.9 If an Authorised User changes their role or ceases employment with the Customer, then the Customer may substitute another natural person as the relevant Authorised User. The Customer must not otherwise change Authorised Users or permit any sharing of an Authorised User's access rights. The Customer may only register the same Authorised User once during the subscription period. The Customer may not substitute a user with a person who was a previous Authorised User during the same subscription period.

3.10 These terms, including this clause, are governed by and must be construed in accordance with the laws in force in the State of New South Wales. The Customer and Distributor submit to the exclusive jurisdiction of the courts of the State of New South Wales and the Commonwealth of Australia in respect of all matters arising out of or relating to these terms, their performance or subject matter.

3.11 The Distributor holds the benefit of these terms on trust for Standards Australia and may enforce these terms on Standards Australia's behalf and for Standards Australia's benefit.


Schedule 2 - Standards Australia Named User Subscription terms

1. Application

1.1 This Schedule applies if the User is provided with access to Standards Australia Licensed Material under a Named User Subscription.

1.2 Where this Schedule applies to a Subscription, it prevails over Schedule 1 in respect of that Subscription.

2. Definitions

2.1 In this Schedule, the following terms have the following meanings:

AuthenticationA reliable means (such as a password and remote access key) to ensure that each person who has access to Licensed Material is an Authorised User.
Authorised UserAn end user who is authorised by a Customer to access (including to view) or use Licensed Material.
CustomerThe User (as defined in the Terms of Use).
DistributorClearCalcs Pty Ltd trading as Calcs.com (ABN 42 614 037 400).
Intellectual Property RightsAll present and future rights conferred by statute, at common law or in equity and wherever existing, including: (a) patents, designs, copyright, rights in circuit layouts, trademarks, know how, brand names, domain names, inventions, product names, trade secrets and any other rights subsisting in the results of intellectual effort in any field, whether or not registered or capable of registration; (b) any application or right to apply for registration of any of these rights; (c) any registration of any of these rights or any registration of any application referred to in paragraph (b); and (d) all renewals and extensions of these rights.
Licensed MaterialAny material, document or publication (in whole or in part) which Standards Australia has licensed the Distributor to distribute.
Named User SubscriptionA Subscription provided by the Distributor to the Customer on a named user basis, under which each Authorised User is individually identified and registered.
Related Bodies CorporateHas the same meaning as in Section 50 of the Corporations Act 2001 (Cth).
Standards AustraliaStandards Australia Limited ABN 85 087 326 690.
SubscriptionAgreement, arrangement or understanding between the Distributor and a Customer which entitles one or more Authorised Users to access (including to view) the Licensed Material (as updated from time to time) during a specified term.
Subscription TermThe specified term of a Subscription.

3. Named User Subscription terms

3.1 If an item of Licensed Material is distributed to the Customer under a Named User Subscription, the Customer is granted a non-exclusive, non-transferrable, non-sublicensable, limited licence, for the duration of the Subscription, to permit each Authorised User to do the following:

  1. access and open the item on one device at a time;
  2. print the whole or any part of the item;
  3. add notes to the item;
  4. share added notes with other Authorised Users within the same Subscription;
  5. download a copy of the item to a local device (which can only be opened on that device); and
  6. store and access a cached version of the item in a browser for up to 30 days,

without the right to copy, reproduce or distribute the whole or any part of the item except to exercise the rights specifically conferred above.

3.2 The Customer may not sell, share, rent, lease or otherwise provide access to the Subscription and the Licensed Material or the Customer's login credentials to any individual or organisation other than the Customer's Authorised Users.

3.3 The Customer must ensure that access to Licensed Material is limited to the Customer's Authorised Users.

3.4 The Customer must keep its Authorised Users' relevant Authentication information confidential and safe from access by unauthorised users.

3.5 The Customer agrees that:

  1. Standards Australia and its licensors are, and will remain, the owners of all Intellectual Property Rights in the Licensed Material;
  2. the Customer must not remove, alter or obscure any ownership, copyright, trade mark, confidentiality or other marks or legends (including any digital watermark or other digital rights management tool) on or in the Licensed Material;
  3. the Customer will protect the security of the Licensed Material in its possession and preserve the Licensed Material and Standards Australia's Intellectual Property Rights;
  4. the Customer must ensure that the Authorised User complies with these Named User Subscription terms; and
  5. upon termination or expiry of the Subscription, the Customer must, and procure each Authorised User to, destroy or delete all copies, in whatever format, of any saved and printed Licensed Material made available under the Subscription.

3.6 The Customer shall not loan, sell, rent, lease, reproduce, or otherwise distribute any of the Licensed Material obtained through the Subscription, in any format, by electronic mail or other means, to any individual or organisation other than an Authorised User at an Authorised Site, without the prior written permission of Standards Australia.

3.7 The Customer must ensure that the logins for each Authorised User are unique logins. Generic logins are not allowed. Each Authorised User must be a natural person, and an employee of the Customer. A contractor, consultant or affiliate of the Customer cannot be a permitted Authorised User of the Customer's Subscription.

3.8 For the purposes of clause 3.7, an employee includes a full-time, part-time, casual or fixed term employee, and Authorised Users may include employees of the Customer's Related Bodies Corporate.

3.9 If an Authorised User changes their role or ceases employment with the Customer, then the Customer may substitute another natural person as the relevant Authorised User. The Customer must not otherwise change Authorised Users or permit any sharing of an Authorised User's access rights. The Customer may only register the same Authorised User once during a Subscription Term. The Customer may not substitute an Authorised User with a person who was a previous Authorised User during the same Subscription Term without purchasing an additional user licence.

3.10 Without limiting the restrictions above, the Customer shall not reproduce or communicate material from Licensed Material other than for the Customer's internal business purposes (excluding the business purposes of the Customer's related entities, associates, shareholders and subcontractors).

3.11 These terms, including this clause, are governed by and must be construed in accordance with the laws in force in the State of New South Wales. The Customer and Distributor submit to the exclusive jurisdiction of the courts of the State of New South Wales and the Commonwealth of Australia in respect of all matters arising out of or relating to these terms, their performance or subject matter.

3.12 The Customer consents to Standards Australia sending the Customer communications, including 'commercial electronic messages' (as that term is defined in the Spam Act 2003 (Cth)), via emails, text messages or phone calls, which Standards Australia will send to the contact details the Customer provides to the Distributor when purchasing a licence to Licensed Material, when purchasing a Subscription, when creating an account on the Distributor's Platform, or as the Customer otherwise updates from time to time.

3.13 The Distributor holds the benefit of these terms on trust for Standards Australia and may enforce these terms on Standards Australia's behalf and for Standards Australia's benefit.

4. How access works

Summary only. This section describes how access to Licensed Material is delivered under a Named User Subscription. It is not part of the terms and creates no rights. Clause 3 prevails to the extent of any inconsistency.

  • How you read an item. An Authorised User can open an item in the web viewer, in the mobile app, or as a PDF downloaded to a local device. What you can do with it depends on which of those you are using.
  • Printing. Printing is done from the PDF, and is unlimited. Every printed page carries a watermark showing the organisation name, the date, and a notation that reproduction, distribution and storage or use on a network is prohibited. The web viewer does not print.
  • Downloads. The PDF can be downloaded to a local device. Downloaded files are locked to the device they were saved on. A copied file will not open elsewhere, and files must not be stored on shared network drives.
  • Caching. A cached version can be stored and accessed in a browser or app for up to 30 days.
  • Copying and forwarding. Copy, cut and paste, and forwarding are disabled.
  • Concurrent use. Each Authorised User can open an item on one device at a time.
  • Removing a user. When an Authorised User is removed, access for that user is blocked within 24 hours.
  • Expiry. On expiry of the Subscription, all saved and printed copies of Licensed Material must be deleted or destroyed.
